By using The Web Depot as an Internet Server, you (hereafter referred to as The Client) agree to the following:

Payment of Fees: All services will be paid for in advance. If payment is not received on or before the due date, all services for The Client's account will be suspended. Services will be resumed upon receipt of the payment.

Availability of Services: The Web Depot will make every effort to provide service on a continual basis. However, occasionally it may be necessary to suspend services for maintenance purposes or for reasons beyond our control. These include, but are not limited to, the following: Power Outages, Fire, Theft, Floods, High winds, Tornadoes, Riots, Civil Disturbances, War, Earthquakes, Volcanic Eruption, Lightning, or any other Acts of God. The Web Depot will attempt to keep these interruptions to a minimum. However, The Web Depot will not be held liable for any interruptions of service, regardless of the cause. The Client assumes full responsibility for the back-up of data stored at The Web Depot.

Software Support: The Web Depot does not support the software programs required to access our services. These include, but are not limited to the following: Browsers (Netscape Navigator, MS Internet Explorer, Spry Mosaic, etc.), E-mail clients (Eudora, Outlook, Pegasus, etc.), FTP Clients (WS_FTP, MS FTP, etc.), HTML Editors (Microsoft FrontPage, Netscape Navigator Gold, Hot Metal, etc.). The Web Depot will provide configuration information (server names, DNS server IP addresses, etc.) as needed.

Unsolicited Commercial E-mail (UCE or SPAM): The Web Depot, Inc. has a ZERO TOLERANCE policy on Unsolicted Commercial Email (UCE or SPAM). We will immediately terminate service to any account which uses UCE. We will immediately remove any site which uses UCE to promote itself in any way. This includes UCE sent from another providers system which promotes a site hosted by The Web Depot, Inc. We will charge a fee of $500 per UCE message sent, AND terminate the account. Using The Web Depot, Inc. systems to relay UCE will also result in a fee of $500 per server transaction.

Programs and/or scripts: Custom CGI, Script, Perl, ISAPI etc. programs must be pre-approved by The Web Depot before they can be run on The Web Depot system. This is to insure stable server operation to all of our clients.

Virtual Domains: Domain Name availability is beyond our control and subject to InterNIC approval.

Content: All software, programs, scripts, graphic images, or other content, remain the property of The Client. The Web Depot assumes no responsibility for any software, scripts, graphic images or any other content of The Client that is published on The Web Depot. The Client agrees to assume all responsibility for the content of The Client's web and/or FTP site. The Web Depot will not be held liable for any damages that result from the posting or distribution of copyrighted or unlawful material(s) that The Client stores at The Web Depot. The Client agrees to abide by all Rules, Laws and Regulations that are applicable. The Client agrees that The Web Depot is in no way responsible for The Client's use of the Internet or The Web Depot.

Rules: Any attempt by The Client to circumvent the rules and regulations of The Web Depot shall be grounds for the early termination of service. These include, but are not limited to: Using more disk space than the contract allows; using, or attempting to use, The Web Depot for illegal activities, including the posting of illegal or copyrighted material, or the use of The Web Depot, Inc. sytem to relay UCE (SPAM); excessive use of bandwidth; unauthorized use of CGI programs, scripts or any other programs; "hacking"or attempting to "hack", disrupt, gain unauthorized access to the services, files or any other content of The Web Depot or its' clients; non payment of fees; Using UCE (Unsolicited Commercial E-mail or SPAM) to promote a site. The Web Depot may terminate any Client that continually causes slow access to The Web Depotor any of The Web Depots' clients. The Client agrees that The Web Depot shall be the sole determiner of these or any other abuses.

The Web Depot will not pay or re-emburse The Client for damages, actual or otherwise.
